What “Special” means in the context of the Virgin Islands Special Trusts Act

This article provides a short exposition and critical evaluation of the Virgin Islands Special Trusts Act 2003 (“VISTA”). In particular, it looks at the question whether a settlor can achieve what VISTA allows by appropriate drafting. As can be seen, there appears to be disagreement among two of the leading practitioners’ works on this question. This article looks at the nature of that disagreement and how it might be resolved.
